Colo. theater lacked security, unlike some peers

(AP) ? The Colorado movie theater complex that was the scene of a gunman's massacre this month didn't have any uniformed security guards on duty the night of the shooting, even though other theaters operated by the same company did provide such protection for the busy premiere of the Batman film "The Dark Knight Rises."

It's impossible to know whether guards ? often off-duty police officers ? at the Aurora Century 16 would have spotted the suspected gunman, James Holmes, and thwarted the attack that left 12 moviegoers dead and dozens wounded on July 20.

Officers hired as guards are generally armed and usually spend their time roaming the complex, checking bags or dealing with minor disputes.

Cinemark provided off-duty police guards at the Aurora theater on busy Friday and Saturday nights. As for other nights of the week, theater operators decide on a case-by-case basis whether to hire security, depending on the likelihood of trouble. The attack came early Friday, shortly after the midnight screening of the Batman film began.

Larry Lowak, whose son Brent was among the wounded, said security personnel on the scene possibly could have stopped the gunman, and he was dismayed to learn that guards weren't on hand.

"If you bring in security on Friday or Saturday, you sure as hell want to bring it in for this particular function," Lowak said.

Plano, Texas-based Cinemark, which operates the Aurora theater, declined to explain why guards weren't provided in Aurora that night and declined to discuss safety policies in general.

Through interviews with police officers and officials outside the theater company, The Associated Press was able to identify places around the country that did use armed security workers for the July 19-20 Batman showings ? including places like Beaumont, Texas; Lake Charles, La., and Tupelo, Miss.

Some other locations, including a Cinema Century 16 theater in the western Denver suburb of Lakewood, did not have security.

Aurora Police Chief Dan Oates has said that the Cinemark in Aurora normally uses off-duty officers to provide security on weekend nights but did not have any working for the July 19 showings that went into the next morning. The theater does not have an unusually high record of complaints or crimes, police Sgt. Cassidee Carlson said.

In Moosic, Pa., Cinemark has worked for years with off-duty officers from the local police department ? typically on Fridays and Saturdays ? and authorities said they were asked to provide two officers on July 19 because the midnight showing was likely to be a major event.

"If they're expecting large crowds, they call our department for additional police presence," said Moosic Borough Police Officer James Giehl.

Two major multiplexes in Amarillo, Texas, including one Cinemark facility, also ensured that off-duty uniformed police officers were present for the first screenings of the Batman film. Amarillo Police Cpl. Jerry Neufeld said that the off-duty officers work in pairs; the town's theaters made a point of asking for them on the busy opening night.

There were no incidents at the screenings, and Neufeld said he heard that people were, as always, happy to see people there to deal with any dangers.

"When they're there, they're visible, people see them and people come in and say, 'hey man, we're glad you're here,'" Neufeld said. "It gives people a sense of calm."

The Aurora shooting has stirred discussion about appropriate security precautions at gathering places commonly considered safe from the cares and worries of the outside world. Experts say that security at public venues has increased substantially over the past decade, but they also note that it's impossible to maintain perfect safety at all times.

Officials have said the Aurora shooting suspect bought a ticket to the midnight showing and went into the theater as part of the crowd. A federal law enforcement official said suspect Holmes is believed to have propped open an exit door in the theater as the movie was playing, donned protective ballistic gear, re-entered about a half-hour into the film and opened fire.

Aurora police said the suspect tossed two gas canisters into the crowd and had an AR-15 assault rifle, a shotgun, and two .40-caliber Glock handguns.

Some theaters have added security guards for all nights of the week since the shooting, and police departments around the country have also conducted extra patrols that focus to movie theaters, though it's not clear if those shifts will be permanent. AMC Theatres has barred people from wearing masks or bringing fake weapons inside its buildings.

Many theaters, including the Cinemark in Aurora, prohibit patrons from bringing in their concealed weapons they use for personal protection.

That irks people like Dudley Brown, executive director of Rocky Mountain Gun Owners, who said that he has refused to go to Aurora theater because of that ban.

"What could have stopped this is law-abiding citizens being allowed to carry," Brown insisted.

Lowak, the father of the shooting survivor, also said he believes people carrying concealed weapons might have helped limit the bloodshed.

But Hubert Williams, former head of the Newark police department and president of the Police Foundation, said that the idea that average citizens with guns could keep a theater safe only makes sense "on a piece of paper."

"Reality is much more complicated. What if you pull a gun out, take aim and someone else thinks you're the shooter?" he asked. "Would you stand up against an AR-15, AK-47 military-style assault weapon? Give me a break."

Penn State likely will loan money to pay NCAA fine

WASHINGTON (AP) ? The president of Penn State says the university will probably have to give its athletic department a long-term loan to pay the $60 million fine imposed by the National Collegiate Athletic Association in light of the child sex abuse scandal.

Rodney Erickson told CBS's "Face the Nation" program in a broadcast aired Sunday that a combination of funds including the football program's financial reserves will be used to pay the fine.

Asked whether Penn State had put too much emphasis on football, Erickson called the athletics program "a tremendous success" but said some parts perhaps "became too much areas unto themselves."

Erickson also said people will have to judge for themselves the legacy of longtime coach Joe Paterno, but he said he believes the coach's educational legacy will stand.

Ireland's NTMA Debt Office Chief Sees Need For Bank Debt Deal

Ireland will need some sort of euro-zone deal to relieve its huge banking debts for it to make further progress toward securing a permanent return to capital markets, the head of the National Treasury Management Agency, the country's debt office, said Sunday.

The Irish government last week hailed as a significant step its first sale of long-term debt for almost two years, when escalating bank-rescue costs forced it to embrace an international bailout.

It wants to be the first bailed-out country in the euro zone to emerge from an emergency program when the 67.5 billion euros (83.1 billion dollars) in loans it agreed in November 2010 with the European Union and International Monetary Fund expire at the end of 2013.

It has long said it deserves to "retro-refinance" as much as possible of the 64 billion euros Irish taxpayers injected to recapitalize and pay back private bank bond debt in six lenders since the onset of the country's severe property market crash in 2008.

Ireland last week raised over 5.2 billion euros by selling bonds at an average 5.95% rate, and will "hopefully" sell more debt at lower yields if the country benefits from a deal on the debts it incurred in saving its banks from collapse, NTMA Chief Executive John Corrigan told Irish broadcaster RTE Radio.

"It is important that that relief be forthcoming if we are to benefit from further reduction in yields and ongoing access to the market," he said, without saying how far yields would need to fall before Ireland could permanently sustain long-term market access.

"The mood music in Europe has to improve before you see yields fall very dramatically, but we are very well positioned for that," he said.

Following what they described as a "breakthrough" agreement at a leaders' summit late last month, Irish ministers have said they are confident the euro zone will agree to some sort of deal to refinance a significant part of the country's bank-rescue debts before October.

Government bond investors are pricing in to "a greater or lesser extent" that the euro zone will agree some such deal on Irish bank-related debts, Mr. Corrigan said Sunday.

LONDON (AP) ? Camille Muffat of France edged Allison Schmitt of the United States by less than half a stroke to win the Olympic 400-meter freestyle Sunday.

Muffat clocked an Olympic-record 4 minutes, 1.45 seconds, while Schmitt was second in 4:01.77.

Defending champion and local favorite Rebecca Adlington made a late charge to take bronze in 4:03.01 for Britain's first swimming medal in the London Games.

Olympic viewing: NBC critics loud on social media

(AP) ? In the age of social media, NBC now has millions of television critics who make their opinions known about every aspect of Olympics coverage instantly.

They've even set up their own hashtag on Twitter: (hash)nbcfail. The online complaints focused Saturday on NBC's decision to air the marquee swimming event won by American Ryan Lochte on tape delay in prime time, and Friday on the network not streaming the opening ceremony online. Sunday's critics started early: people wondering why the U.S. men's basketball team's opening game aired on a cable network while women's cycling was shown on NBC.

The conversation is so active that NBC's executive producer of the games, Jim Bell, took to Twitter to answer critics and even change the way NBC is doing something in response.

"(hash)nbcfail is filled with a lot of crying and snark and humor, but NBC can actually learn something from it," said Jeff Jarvis, a media critic who writes the Buzzmachine.com blog.

Complaints about tape delayed coverage are an evergreen with Olympics held on foreign soil. But the London Games are the first with Twitter, Facebook and other social media sites in full flower, in a mobile phone era where people carry computers that instantly deliver news in their pockets. It has amplified the impatience of viewers who want to see events on their large-screen TVs instantly and haven't been mollified by NBC's decision to stream the events live online.

James Poniewozik, Time magazine TV critic, tweeted that "NBC tape delay coverage is like the airlines: its interest is in giving you the least satisfactory service you will still come back for."

That drew a quick response from NBC's Bell: "You do know that all sports events are being streamed live right?"

"I do, indeed!" replied Poniewozik. "Have enjoyed it. Apparently a lot of folks still prefer watching it on TV."

NBC says it saves big events for prime-time airing because that is when most viewers are available to watch them and where the network makes the bulk of its advertising revenue. Since prime time on the U.S. East Coast coincides with 1 a.m. London time, there are no events to air live then. NBC representatives noted that there were 39 hours of live events Sunday on NBC and its affiliated networks.

Jonathan Wald, who produces Piers Morgan's CNN talk show and used to work at NBC, tweeted that "the medal for most Olympic whining goes to everyone who complains about what happens every four years. Tape delay."

One of those complainers, in fact, was Morgan: He tweeted his disdain Friday for NBC's decision not to make the opening ceremony available live.

The advent of Twitter makes it seems like there's a lot of unhappiness when the majority of viewers are watching NBC on tape delay and appear satisfied with it, Wald said in an interview.

NBC can point to television ratings justifying their approach. The Nielsen company said the opening ceremony drew more than 40 million people Friday, the most ever for one of those Olympic events. Saturday's first night of coverage was seen by 28.7 million, another record, beating every other first night of Olympic competition. In Beijing four years ago, 24 million watched on the corresponding night.

Jarvis said he believes NBC could satisfy fans by, for example, televising events like Lochte's race live in the afternoon and then repeating it at night. He acknowledges, though, that he's not the one who'd potentially be risking millions of dollars in advertising revenue if such a decision cut into prime-time viewing.

NBC has tried to "hold on to old media strategies in a new media world," Jarvis said. "And that's a mistake."

Some of the online complaints seem to take special glee in bashing NBC, with a few describing it like an Olympic sport of its own. Some are quite personal, like the CNN producer who tweeted Sunday: "No USA basketball in my hotel room. Why they aren't putting it on NBC's main channel is beyond me!"

Bell, in some of his back-and-forth with online critics Sunday, answered one tweeter who described herself as a St. Louis mom and complained about NBC's "Nightly News" on Saturday airing results of events that hadn't been shown on the network yet. Bell tweeted that he'd look into it, and shortly after told her that "Nightly News" would announce a "spoiler alert" to tell people to avert their eyes if they didn't want to see results.

Not everyone online is a critic. On Sunday, the U.S. Olympic sailing team tweeted that it was "by far the greatest sailing TV coverage in Olympic history."

Colorado movie house massacre suspect was under psychiatrist's care

DENVER (Reuters) - A former University of Colorado graduate student accused of killing 12 people and wounding 58 others in a shooting rampage at a Denver-area movie theater last week had been under the care of a psychiatrist who was part of a campus threat-assessment team.

The disclosure came in court documents filed on Friday by lawyers for James Holmes, 24, who is accused of opening fire last Friday on a packed showing of the latest Batman movie, "The Dark Knight Rises," in the Denver suburb of Aurora.

The defense attorneys, in their request to an Arapahoe County district judge, are seeking a court order requiring prosecutors to turn over the contents of a package that Holmes sent to Dr. Lynne Fenton and was later seized by investigators.

"Mr. Holmes was a psychiatric patient of Dr. Fenton, and his communications with her are protected," the filing said.

Fenton, medical director for student mental health services at the University of Colorado-Denver Anschutz Medical Campus, provides medication and psychotherapy for graduate students in addition to her teaching responsibilities, according to a school website.

A professional biography of Fenton posted on the site said she had conducted research on schizophrenia, including a two-year grant to work in the schizophrenia research department of the U.S. Department of Veterans Affairs from 2008 to 2010.

Fenton is also a member of the campus-based "behavioral assessment and threat assessment team," which helps faculty and staff deal with "individuals who may be threatening, disruptive or otherwise problematic," according to that group's website.

It could not be ascertained if Fenton was caring for Holmes under the threat-assessment program or under routine counseling she provided to students on campus.

Fenton could not immediately be reached by Reuters for comment, and a spokeswoman for the University of Colorado medical school declined comment, citing restrictions under a gag order issued by the judge presiding over the case.

The university, where Holmes had been enrolled as a doctoral student of neuroscience, confirmed earlier this week that a suspicious package was delivered by mail on Monday and that it was "immediately investigated and handed over to authorities within hours."

DEFENSE LAWYERS SEEK SANCTIONS FOR MEDIA 'LEAKS'

Fox News has reported, citing an unnamed law enforcement source close to the investigation, that two packages were sent by Holmes to a psychiatrist on the faculty of the University of Colorado, and that one contained a notebook detailing the shooting scenario. According to Fox News, the notebook contained hand-drawn illustrations of stick figures shooting at other stick figures.

The defense motion accuses of the government of leaking information to the media in defiance of a gag order, thereby jeopardizing Holmes' rights to due process and fair trial by an impartial jury. It says his lawyers will request a hearing to determine "appropriate sanctions for this misconduct."

Prosecutors, responding to the discovery motion, disputed various elements of media accounts as being erroneous, suggesting that anyone who had provided information to Fox News and other outlets lacked real knowledge of the case.

"These factual errors lead (the government) to believe ... that the media is getting information from hoaxers, fraudsters, or maybe from nobody at all by creating fake 'law enforcement sources' out of whole cloth," prosecutors said in their filing.

Formal charges against the suspect, who dyed his hair bright orange and was said by authorities to have referred to himself as the Joker - Batman's comic book arch enemy - are expected to be filed in court on Monday.

The judge in the case, William Sylvester, set a hearing on the defense discovery motion to be held as part of Monday's proceedings.

Arrested within minutes of the shooting rampage at his car in the theater's parking lot, Holmes is being held in solitary confinement in the local jail.

In addition to charges stemming from one of the worst outbursts of U.S. gun violence in recent years, he is accused of wiring his apartment with enough explosives to have leveled the entire building if they had been detonated.

The apartment house was evacuated when the booby traps were discovered. But the explosives were later safely dismantled and removed by authorities, and Holmes' neighbors began returning to their homes on Wednesday night.

The latest disclosures about the suspect came to light as mourners attended the third funeral in as many days for one of the victims of the shooting rampage, this one for an 18-year-old high school graduate, Alexander J. "AJ" Boik," who was bound for art college in the fall.

Aurora's Queen of Peace Catholic Church was filled with hundreds of mourners, including Colorado Governor John Hickenlooper, Aurora Mayor Steve Hogan and a contingent of Aurora police officers and firefighters.

Boik was one of the youngest among 12 people, aged 6 to 51, killed in the hail of gunfire early last Friday, just after midnight. Of the 58 wounded, 12 remain hospitalized, including five in critical condition.

Out of Africa: Startling New Genetics of Human Origins

Western Pygmies

I love population genetics for its ability to peer back into human history through the medium of DNA?s ATCGs.

One of the stars of this discipline is Sarah Tishkoff, a standout in African genetics, someone who will readily haul a centrifuge into the bush in Cameroon.

Tishkoff of the University of Pennsylvania is lead author on a paper published online July 26 in?Cell that details? whole-genome sequencing of five individuals each from three extant hunter-gatherer groups?the Pygmies of Cameroon as well as the Hadza and the Sandawe of Tanzania. The results reveal millions of newly discovered genetic variants?differences in single genetic letters, the ATCG?and indicate that early modern humans may have interbred long ago in Africa with another species of hominid (although the fossil record does not provide much support for the latter finding).

Tishkoff answered a few questions for us about this paper, co-authored with Joseph Lachance and 11 other researchers, and talked about where her work is headed. An edited version of the interview appears below:

Please describe the research that led to the paper that was published today:

We?re the first ones to look at these diverse groups of hunter-gathers in Africa who descend from some of the most ancestral lineages in the world. They?re? interesting because they have very unique and distinct lifestyles There are few? populations that maintain this active hunter-gatherer lifestyle.

This is the most extensive study in Africa using high-coverage deeply detailed sequence data. We focused on three groups because they?re? anthropologically interesting. They?re thought to be descended from groups that are ancestral to all modern humans. We wanted to understand genetic basis of adaptation to their local environment? including, for instance the short stature trait in Pygmies.

So what did you find?

We discovered 13 million variants and, of those variants, greater than 3 million are completely novel, meaning that they have not been reported in any database. The current public database has 40 million variants. So we found 3 million novel variants by simply sequencing 15 individuals. That increases by about 8 percent all known human genetic variation. It also demonstrates that we?re missing a lot of really important variation that?s out there, particularly in Africa, which is the? homeland of modern humans and a place where there?s been a lot of time for differentiation to have occurred in very diverse environments. What this means is that there?s s probably a lot of regional or population-specific variation out there that has not been that well characterized, some of which is functionally very important?

What about natural selection?

Natural selection seems to be operating more on the non-coding genome [the regulatory portion that does not contain genes] than the coding region. A lot of people are doing exome sequencing [looking only at genes]. I think they?re missing a lot of important variation.

In our study, we looked at what regions of these groups? genomes were uniquely differentiated to their local environments. There wasn?t a huge amount of overlap between the groups?or between them and other non-hunter-gatherer groups from Africa.? Due to natural selection, there were distinctive adaptations for? immunity, taste and smell.

In the Pygmies, we found genes involved with thermal regulation, immunity and stature, all likely to be adaptive to a tropical environment. We found genes related to pituitary and thyroid function, the latter perhaps an adaptation to a low-iodine environment.

In the Sandawe, we found a variant for? melanin, a gene involved in skin color.? The Sandawe are among the most fair-skinned groups in Africa. When I went to work with them, they said, ?We?re like brothers and sisters because you look like us.? This is not because of any European admixture; they look like the San [a hunter-gatherer group from southern Africa]. When I said: ?Where do you come from, they pointed to a mountain in the distance. When I said ?Can you take me there?? there was no road. We went through the bush and they showed me cave paintings. Having lived in South Africa, I?ve seen the cave paintings of the San.

What about interbreeding with other human species?

A number of studies have shown a low amount of interbreeding between early modern humans outside of Africa and archaic species outside of Africa including Neandertals and, in Asia, with the species they call Denisova.They?ve never found any evidence of Neandertal DNA in Africa. The problem is that you just don?t get good preservation of fossils in Africa.? So what we did was collaborate with Josh Akey and Ben Vernot at the University of Washington and used a statistic they developed to recognize regions of genome that appear to be of archaic origin.

The first thing we did is to test this statistic by applying it to non-Africans and we found a very strong enrichment for Neandertal DNA in those genomes. But we? don?t see that in the Africans. They have no Neandertal DNA. When we apply the statistic to Africans, though,? we still see a lot of evidence for interbreeding from a hominid who diverged from a common ancestor that we shared about 1.2 million years ago, about the time that Neandertals split off as well. This suggests that there could have been a sister species in Africa. What it was nobody knows. But it seems to show that modern humans have been interbreeding and it?s not unique to non-African species.

Why are African genetics so exciting?

Africa was the site of origin of all modern humans and if you want to learn about when, where and how we evolved, you want to look at this continent. It has a long history of population subdivision and adaptation of those populations to very distinct environments and a broad range of phenotypes, ranging from the short stature of the Pygmies to the? very tall stature of the pastoralists in the east. It also has very different disease exposure and very different disease prevalence throughout.

What?s next?

We want to expand our genome-wide analysis to other populations, and we want to do so with larger sample sizes. We?re going to continue to try to correlate genetic variants with different phenotypic traits. We?d love to do functional studies of these genes to see, for instance, how they are regulating pituitary development. Is there some totally novel mechanism involved. We?re going to look at the Pygmies and other groups with a systems approach. You can?t look at height, for instance, by itself. You have to look at it in relation to metabolism and immunity and see how everything interacts.

Dave Orrick: For Minnesota, Wisconsin hunters, planning starts now ...

It's never too early to start planning your next hunt. In fact, now is the right time for many hunting plans to be made, especially if it involves a kid.

August brings the beginning of clinics, registrations, applications and lotteries for limited-access, mentored and other special hunts.

There are too many to provide a full list here, so Minnesota and Wisconsin residents should check the websites of their Departments of Natural Resources, as well as TwinCities.com/Outdoors for updates.

Here are a few:

-- A youth waterfowl hunt -- a two-week jump start youths get on the rest of us -- is set for Sept. 8.

Every parent who isn't an expert waterfowler should consider applying for their child to participate in a mentored youth waterfowl hunt. I tagged along for one last year, and both father and son agreed that learning from a veteran who has scouted the marsh and stresses the fundamentals is a great way to start a duck hunting season, or career.

In Minnesota, 80 spots are available for youths ages 12 to 15 who have a firearms safety certificate. If more than 80 apply, a lottery will be held.

The deadline to apply is Aug. 13. Go to mndnr.gov/ discover for an application, or call 651-296-6157.

-- A firearms safety certificate is required for most hunting these days. "Fall" classes begin as soon as this month, and many are already full. Lists of classes are available at the

DNR websites for both states. In both states, online courses are also offered via HunterCourse.com.

-- Exactly 186 permits are available to hunt prairie chickens in west-central Minnesota for five days beginning Oct. 20.

The application deadline is Aug. 17. Only Minnesota residents can hunt. You can apply as an individual or in groups up to four.

Odds are about one in three you'll be selected, said Steve Merchant, DNR wildlife population and regulation manager. In 2011, an estimated 103 birds were killed with 45 percent of hunters taking at least one bird.

The bag limit will be two prairie chickens.

-- Other events: For the first time, fall turkey hunting licenses will be sold over the counter, meaning no special application will be needed. ... The Minnesota DNR will offer a deer hunting clinic through its Becoming an Outdoors Family program from 9:30 a.m. to 3 p.m. Aug. 12 in Kanabec County. C.bank says to stabilize lending rates for at least one year ...

The governor of the central bank, Nguyen Van Binh, has committed to keep lending rates at 15% a year for at least one year and to do his best to ensure interest rate stability for a couple of years to pull the economy out of the doldrums.

?As the governor of the State Bank of Vietnam, I reassure you that the lending rate of 15% will be kept stable for at least one year and we will try to ensure rate stability in the future,? Binh told business executives at a dialogue held by the central bank and Hanoi City last Friday.

Binh attributed his commitment to the fact that the national inflation only stays at 7-8% this year, allowing commercial banks to push lending rates down below 15% as targeted. ?The orientations and measures to lower the rates below 15% are very clear and what we are doing now is to turn it into reality,? Binh responded to firms that urged SBV to order member banks to conform to the rate cut.

Thu Ha, director of Lexim, which specializes in trading construction machinery and equipment, said local banks have lent to her business at an annual rate of up to 24% in 2010-2012. Therefore, she insisted lending rates should be slashed to 15% and should remain unchanged for at least one year.

Ha noticed Eximbank already adjusted down its lending rate to less than 15% at the governor?s request but she wondered how long the rate will stay there.

Tran Anh Vuong, representative of the Hanoi Youth Business Association, expressed his concerns over whether the central bank?s instruction that forces lenders to lower interest rates of old loans to 15% could work.

?I suggest the governor should announce the addresses and phone numbers of relevant authorities so that local companies could inform them of any problems that arise,? Vuong said.

Governor Binh admitted a specific ceiling lending rate is not mentioned in the prevalent regulations. ?SBV has only called on commercial banks to lower rates for old loans to help corporate borrowers get out of the woods. This means the monetary authority cannot punish violators, if any, based on the current legal system.

?The point is we must be fully aware of social responsibility as banks are supposed to reduce interest rates as soon as conditions allow them to do that.?

Only five days after the central bank released the instruction on rate cuts, most credit institutions in the country have pledged to do as told.

He asserted: ?We declare the banking system will only strive for credit growth of 8-10% as the increase is appropriate and would not cause inflation in the years to come.?

Nguyen Thi Mai Suong , director of the Hanoi Branch of the central bank, noted all 12 commercial banks and eight finance leasing companies based in the capital city and branches of State-owned lenders had revised down old loans rates to a maximum of 15%.

According Suong, banks in Hanoi have already reduced rates for 30-50% of the old credit contracts with rates of over 15%. At two State-run banks, Vietcombank and BIDV, interest rates for all credit contracts have went down below 15%, Suong said, adding other lenders in the city are racing to complete their rate cuts this month.
